Terms of Service

1. Introduction & Acceptance

By accessing or using MRKT Mesh (“the Service”), you agree to be bound by these Terms of Service (“Terms”). The Service is provided by Maison MRKT LLC (“we,” “us,” or “our”). If you do not agree to these Terms, do not use the Service.

2. Service Description

MRKT Mesh is a server-side conversion tracking platform that processes e-commerce events from your Shopify store and delivers them to third-party marketing destinations including Meta (Facebook), Google Analytics 4, Google Ads, Klaviyo, and TikTok. The Service includes a storefront data layer script, webhook processing, identity resolution, and event delivery infrastructure.

3. Account Terms

• You must be at least 18 years of age or have legal authority to bind your organization.
• You must provide accurate and complete registration information.
• You are responsible for maintaining the security of your account credentials.
• One account per person — shared logins are not permitted.
• You must notify us immediately of any unauthorized access to your account.

4. Billing & Payment

• New accounts include a free 15-day trial. No credit card is required to start.
• Paid plans are billed monthly through the Shopify platform.
• Prices may change with 30 days’ written notice via email.
• No refunds are issued for partial months of service.
• Accounts with failed payments will be suspended after 14 days.

5. Your Data

• You own your data. We process it on your behalf as a data processor.
• We access your Shopify store data only as necessary to provide the Service.
• We do not sell your data or your customers’ data to third parties.
• We hash personally identifiable information (email, phone) with SHA-256 before storage.
• You can export your data at any time via the dashboard or API.
• On account deletion, we delete your data within 30 days.

6. Acceptable Use

• Do not use the Service for any illegal purpose.
• Do not send data to destinations without proper end-user consent.
• Do not reverse-engineer, decompile, or disassemble the platform.
• Do not use automated tools to scrape the dashboard.
• Do not exceed your plan’s order limits without upgrading.

7. Service Level

• We target 99.9% uptime for the event ingestion pipeline.
• We target 99% delivery accuracy per destination.
• We are not liable for outages or errors originating from third-party destination APIs (Meta, Google, Klaviyo, etc.).
• Scheduled maintenance will be communicated with at least 24 hours’ notice.

8. Intellectual Property

• The MRKT Mesh platform, including its code, design, and documentation, is owned by Maison MRKT LLC.
• Your data and configurations remain your property.
• Our data layer script is licensed for use only on stores connected to your MRKT Mesh account.

9. Limitation of Liability

• The Service is provided “as is” without warranties of any kind, express or implied.
• We are not liable for indirect, incidental, special, or consequential damages.
• Our total liability is limited to the fees you paid in the 12 months preceding the claim.
• We are not liable for lost conversions, ad spend decisions, or revenue impact resulting from use of the Service.

10. Termination

• You may cancel your account at any time from the billing settings page.
• We may terminate your account for Terms violations with 30 days’ written notice.
• We may terminate immediately for severe violations including abuse, fraud, or illegal activity.
• On termination, your data is retained for 30 days and then permanently deleted.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
